End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you and SwiftGo governing your use of the SwiftGo mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by this EULA.

1. License Grant

Subject to your compliance with this EULA, SwiftGo grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal or internal business purposes.

2. License Restrictions

You agree not to:

  • Copy, modify, adapt, translate, or create derivative works of the App
  • Reverse engineer, decompile, disassemble, or attempt to discover the source code
  • Rent, lease, loan, resell, sublicense, or distribute the App
  • Remove, alter, or obscure any proprietary notices (copyright, trademark, etc.)
  • Use the App for any unlawful purpose or in violation of applicable laws
  • Interfere with or disrupt the App's functionality or servers
  • Use automated systems, bots, or scripts to access the App without permission
  • Circumvent security features or access restrictions
  • Frame, mirror, or incorporate the App into another product

3. Ownership

The App, including all content, features, functionality, source code, graphics, logos, and trademarks, is owned by SwiftGo and protected by copyright, trademark, and other intellectual property laws. This EULA does not transfer any ownership rights to you.

4. User Content and Data

4.1 Your Content

You retain ownership of any content you create, upload, or submit through the App. By using the App, you grant SwiftGo a worldwide, non-exclusive, royalty-free license to use, store, and process your content as necessary to provide and improve our services.

4.2 Data Collection

Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your data. By using the App, you consent to data collection as described in the Privacy Policy.

5. Updates and Modifications

SwiftGo may release updates, patches, or new versions of the App. You agree to accept such updates, which may be installed automatically. We reserve the right to modify or discontinue features without prior notice.

6. Third-Party Services

The App may integrate with third-party services (payment processors, analytics, cloud storage). Your use of these services is governed by their respective terms and privacy policies. SwiftGo is not responsible for third-party services or content.

7. Termination

7.1 Termination by You

You may terminate this EULA at any time by uninstalling the App and deleting your account.

7.2 Termination by SwiftGo

We may terminate or suspend your access to the App immediately, without prior notice, if you violate this EULA or our Terms & Conditions. Upon termination:

  • Your license to use the App is revoked
  • You must cease all use and uninstall the App
  • SwiftGo may delete your account and associated data (subject to Privacy Policy retention obligations)

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of non-infringement
  • Warranties of uninterrupted, secure, or error-free operation
  • Warranties regarding accuracy or reliability of content

SWIFTGO DOES NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. USE OF THE APP IS AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SWIFTGO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, goodwill, or business opportunities
  • Damages resulting from use or inability to use the App
  • Unauthorized access to or alteration of your data
  • Third-party conduct or content

IN NO EVENT SHALL SWIFTGO'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO SWIFTGO IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless SwiftGo and its affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • Your use or misuse of the App
  • Your violation of this EULA or applicable laws
  • Your infringement of third-party rights
  • Content you submit through the App

11. Export Compliance

The App may be subject to export control laws. You agree not to export or re-export the App to prohibited countries or individuals in violation of applicable laws.

12. Governing Law and Jurisdiction

This EULA is governed by the laws of [Your Jurisdiction], without regard to conflict of law principles. Any disputes arising from this EULA shall be resolved exclusively in the courts of [Your Jurisdiction], or through binding arbitration as specified in our Terms & Conditions.

13. Arbitration Agreement (Apple & Google Compliance)

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, controversy, or claim arising out of or relating to this EULA shall be resolved through binding arbitration administered by [Arbitration Organization] under its rules. You waive any right to a jury trial or to participate in a class action lawsuit.

Exceptions: You may assert claims in small claims court if they qualify. SwiftGo may seek injunctive or equitable relief to protect intellectual property rights.

14. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • This EULA is between you and SwiftGo, not Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • In the event of any failure of the App to conform to warranties, you may notify Apple for a refund. Apple has no other warranty obligations.
  • Apple is not responsible for addressing claims related to the App, including product liability, legal compliance, or intellectual property infringement.
  • Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it.
  • You represent that you are not located in a country subject to U.S. embargo or designated as a "terrorist supporting" country, and you are not on any U.S. government prohibited parties list.

15. Google Play Store Additional Terms

If you downloaded the App from Google Play, the following additional terms apply:

  • This EULA is between you and SwiftGo, not Google. Google is not responsible for the App or its content.
  • Your use of the App must comply with Google Play's Terms of Service.
  • Google is not liable for any claims or damages related to the App.
  • If there is a conflict between this EULA and Google Play's Terms of Service, Google Play's terms shall prevail with respect to the download and use of the App from Google Play.

16. Changes to This EULA

SwiftGo reserves the right to modify this EULA at any time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated EULA.

17. Severability

If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

This EULA, together with our Privacy Policy and Terms & Conditions, constitutes the entire agreement between you and SwiftGo regarding use of the App and supersedes all prior agreements.
